I ask to obtain a copy of the following records held by the Oakland City Administrator: - All notices issued under the Nuisance Eviction Ordinance (hereinafter NEO) and similar or related records relating to notices issued under the NEO since it was enacted in 2004. - All records reflecting evidence of alleged illegal activity that served as the basis for NEO notices. - All correspondence with the City Attorney's Office, including Barbara Parker, Richard Illgen, and other City Attorney employees, regarding the NEO and notices issued under the NEO. I ask for a determination on this request within 10 days of your receipt of it. If you determine that some but not all of the information is exempt from disclosure and that you intend to withhold it, I ask that you redact it for the time being and make the rest available as requested. In any event, please provide a signed notification citing the legal authorities on which you rely if you determine that any or all of the information is exempt and will not be disclosed. If I can provide any clarification that will help expedite your attention to my request, please contact me via email. Given the public interest in the subject matter, and my preference for electronic records, I ask that you please apply a fee waiver to this request. You may email the records to this email address. If my request for a fee waiver is denied, I ask that you please notify me of any duplication costs exceeding $20 before you duplicate the records.

Dear Records Requestor: Staff from the Oakland City Administrator's Office who are working on this request inform me that, as the request is written, the City response would include a large volume of materials, quite possibly in excess of 500 pages. Most of the material regarding NEO evictions and the underlying justifications, I am informed, is retained in hard copy format only, and thus would not be available for transmittal electronically. Accordingly, once the staff identified all documents and made them available to you, you would either need to schedule an appointment during which you could go review all documents in our offices, or alternatively, pay for the City's costs to copy all documents at a rate of 10 cents per page. Given this, please let me know how you wish to proceed. You might consider narrowing the request to a smaller range of dates (e.g., the last three years), or perhaps to start only with copies of the Notices themselves, leaving the documents about "evidence of alleged illegal activity" (which can be quite lengthy) for a subsequent follow-up request. I have instructed staff to continue preparing documents but not to produce any copies yet, pending your direction.
