I am seeking information related to the passage and implementation of Measure H, as approved by the voters of Oakland in 2009 (clarifying the imposition of the Real Property Transfer Tax). In particular, I would like copies of (i) any and all emails or other written communications between and amongst any of the following: the office of the City Attorney, the office of the City Auditor, the office of the Mayor, any and all Councilmembers and their respective offices, the office of the City Administrator, and/or the Finance and Management Agency, or (ii) internal emails or other written communications by and amongst members of any such office, agency or department, to the extent any of the records described in (i) or (ii) above either (a) document or explain why Measure H was needed, (b) explain or document the issue Measure H was designed to address, (c) outline or suggest the specific Oakland Municipal Code changes required to address such issue, (d) document or explain how the Finance and Management Agency would implement Measure H once adopted, (e) provide an estimate of the change in tax receipts expected if Measure H was passed, and/or (f) document the actual change in tax receipts due to the passage of Measure H. The time period can be limited to public records generated or received between January 1, 2006 and December 31, 2011.

The City has not provided documents covered by the attorney-client privilege pursuant to Section 6254(k) of the Public Records Act which states that “Records, the disclosure of which is exempted or prohibited pursuant to federal or state law, including, but not limited to, provisions of the Evidence Code relating to privilege.” There are no more responsive records, and this request will be closed. Requester was previously informed via phone about this determination. However, due to failures in the system, we are able to provide this information through this portal until now.

As mentioned in the voicemail I left for Ms. Flores-Medina earlier this morning, the provided materials do not really respond to the request. I am not looking for the previously released agenda reports and resolutions, I am looking for emails or other communications between the offices I listed that either described why Measure H was required, how it would be implemented, or describes the results of Measure H's passage.
