Pursuant to the California Public Records Request Act, Government Code Section 6250, et seq., we are requesting all records concerning the following subjects, which relate to the collision between pedestrians and a train on the evening of January 12, 2017, near the intersection of Clay Street and Embarcadero West, near Jack London Square in Oakland, California. As used herein, “records” includes all data and documents (including all electronically stored information or databases), including but not limited to, emails, text messages, videos, interviews, drafts, notes, photographs, measurements, any interim or final data analysis or summaries, reports, memos, and talking points, among other things. Unless otherwise noted, all requests seek documents dating from January 1, 2010 to the present. Subjects regarding which records are requested: 1. Record drawings (As-Built) for the sidewalk, street, and cross-walks at Embarcadero West between Webster Street and Clay Street in Oakland, California. 2. Plan-profile sheets representing any pedestrian safety features—including but not limited to any signs, signals, lighting, painting, striping, curbs, crosswalks, barricades, barriers, etc.—existing on Embarcadero West between Webster Street and Clay Street in Oakland, California, on January 12, 2017. 3. Any and all documents reflecting any pedestrian safety features—including but not limited to any signs, signals, lighting, painting, striping, curbs, crosswalks, barricades, barriers, etc.—existing at Embarcadero West between Webster Street and Clay Street in Oakland, California, on January 12, 2017. 4. Any and all documents reflecting any installation or repairs to any pedestrian safety feature—including but not limited to any signs, signals, lighting, painting, striping, curbs, crosswalks, barricades, barriers, etc.—at Embarcadero West between Webster Street and Clay Street in Oakland, California. 5. Any and all documents reflecting the design of Embarcadero West between Webster Street and Clay Street in Oakland, California. 6. Any and all documents, studies, and/or permits related to the construction and/or improvement of Embarcadero West between Webster Street and Clay Street in Oakland, California. 7. Any and all communications or complaints regarding pedestrian safety along Embarcadero West in Oakland, California. 8. Any and all documents, including but not limited to traffic collision reports, police reports, or incident reports, reflecting any claim for personal injury sustained as a result of train traffic along Embarcadero West in Oakland, California. 9. Any and all documents—including but not limited to traffic collision reports, police reports, incident reports, etc.—reflecting any collision(s) between any train(s) and any pedestrian(s) that occurred along Embarcadero West in Oakland, California at any time. 10. Any and all studies or reports related to pedestrian safety along Embarcadero West in Oakland, California. 11. Any and all reports or investigations related to the collision between pedestrians and a train that occurred on Embarcadero West in Oakland, California, on January 12, 2017. 12. Any and all internal or external communications regarding the collision between pedestrians and a train that occurred on Embarcadero West in Oakland, California, on January 12, 2017. 13. Any and all communications between the City of Oakland, Amtrak, Union Pacific Railroad, and/or the Port of Oakland regarding pedestrian safety along Embarcadero West in Oakland, California. 14. Any and all internal or external communications regarding pedestrian safety along Embarcadero West in Oakland, California. 15. Any and all internal or external communications regarding responsibility for pedestrian safety along Embarcadero West in Oakland, California. This public records request includes all documents within respondent’s possession, whether or not the requested documents were created internally or by a third party. If any documents are withheld from production, please provide the title and date of the document, and explain the basis for withholding the document.

The Oakland Police does not have any documents related to this request. Many years ago the state stopped recording Train/Ped accidents on a vehicle collision report. These cases are reported by the responsible train company. Oakland Police also does not have any injury accidents between Auto/Train as requested.
