Under the California Public Records Act § 6250 et seq., I am requesting an opportunity to inspect or obtain copies of any and all publicly available records of the following:

 

  1. All documents that detail spending on homeless encampment removals, relocations, and clean-ups by the City of Oakland for the fiscal years 2016-2017, 2017-2018, and 2018-2019.

 

  1. A copy of City of Oakland policy concerning the identification of unsanctioned or illegal homeless encampments, notification of said encampments’ residents of impending removal or cleaning, and the confiscation and disposal of personal effects seized during sweeps of said encampments on public or private land.

 

  1. A copy of the papers or forms warning of an impending encampment removal or cleaning and the form left for the assumed owners of personal effects seized during sweeps of unsanctioned/illegal homeless encampments on public or private land in the City of Oakland. 

 

  1. Any and all records of call-outs, requests, or scheduled instances of homeless encampment removals, relocations, and/or clean-ups by City of Oakland employees or subcontracted agencies from 2017, 2018, and Jan. 1, 2019 to present. This is intended for Public Works or other agency employees’ records, and does not include Oakland Police Department call-outs unless OPD was the only city agency responding to said call-out.


If there are any fees for searching or copying these records, please inform me if the cost will exceed $1.00.  However, I would also like to request a waiver of all fees in that the disclosure of the requested information is in the public interest and will contribute significantly to the public’s understanding of San Francisco Bay Area cities’ spending on and treatment of homeless citizens. This information is not being sought for commercial purposes.

The California Public Records Act requires a response within ten business days.  If access to the records I am requesting will take longer, please contact me with information about when I might expect copies or the ability to inspect the requested records.

If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law.
