Dear Oakland Police Records Custodian:

I am writing pursuant to the California Public Records Act and newly amended Penal Code Sections 832.7 and 832.8, which state that "the public has a right to know all about serious police misconduct, as well as about officer-involved shootings and other serious uses of force." I am researching officer-involved shootings and other serious uses of force by Oakland Police Department officers. To that end, I request the following records:

  1. Oakland Police Department Records Comprising the Oakland Police Department's Internal Investigation of Former Oakland Police Officer Brendan O'Brien in the Death of O'Brien's Wife, Irma Huerta Lopez: All electronic, email, video, audio, photographic, and paper records comprising the Oakland Police Department's internal investigation of former Oakland Police Officer Brendan O'Brien for his role in the June 2014 shooting death of his wife, Irma Huerta Lopez.
  2. Correspondence Between the Oakland Police Department Personnel That Conducted The Oakland Police Department's Internal Investigation of Former Oakland Police Officer Brendan O'Brien in the Death of O'Brien's Wife, Irma Huerta Lopez: All electronic, email and paper communications between the investigating officers pertaining to the Oakland Police Department's investigation of former Oakland Police Officer Brendan O'Brien for his role in the June 2014 shooting death of O'Brien's wife, Irma Huerta Lopez.
  3. Request For Specific Items:
  4. Video surveillance footage from the Oakland Shell station showing former Oakland Police Officer Brendan O'Brien at the Shell station the day of the June 2014 shooting death of O'Brien's wife, Irma Huerta Lopez.
  5. The body-camera footage recording by Oakland Police Officers Jeryme Stine and Danny Cheng while reviewing the Shell surveillance footage of O'Brien at the Shell station, which had earlier been recorded at the Shell station.
  6. The receipt for a package of cigarettes issued by the Oakland Shell station to former Oakland Police Officer Brendan O'Brien the day of the June 2014 shooting death of O'Brien's wife, Irma Huerta Lopez.
  7. Video footage of the interview of former Oakland Police Officer Brendan O'Brien conducted by Oakland Police Officers Caesar Basa and James M. Gantt as part of the Oakland Police Department's internal investigation of O'Brien for his role in the June 2014 shooting death of O'Brien's wife, Irma Huerta Lopez.

If specific portions of any documents or recordings are exempt from disclosure, please provide the non-exempt portions. Please provide entire documents or recordings, even if only parts of them are responsive to this request. If you are unable to reproduce electronic records in electronic form, please provide a reason for this.

I request that you waive copying fees because I have limited resources, and the information requested will be used in the public interest to further the public’s understanding of the operations of the Oakland Police Department. None of the information obtained will be sold or distributed for profit. If you are unable to waive the copying fees, and you anticipate that these costs will exceed $50, or that the time needed to copy the records will delay their release, please contact me so that I can arrange to inspect the record or decide which records I wish to have copied. Otherwise, please copy and send them as soon as possible.

Please respond to this request within ten (10) days, either by providing all the requested records or by providing a written response setting forth the legal authority for withholding or redacting any record and stating when the records will be made available. If you require any clarification in identifying responsive records or focusing this request, please contact me. Please send all records responsive to this request to the mailing address provided.
