In accordance with the California Public Records Act and the enclosed written
authorization, please research and provide to this office:

 


1. All documents, electronically stored information2 or evidence reflecting any and all
records related to repairs or repair work actually done at the subject location3 from
January 2008 to the present, including repair work that was not done directly to the
street/roadway but that required altering the street/roadway in any way.

2. All documents, electronically stored information or evidence that refer to, evidence or
reflect each and every report of concern or complaint made by citizens, sidewalk
users, drivers, City officials, law enforcement, or any other person regarding the
subject location from January 2008 to the present.

 


3. All documents, electronically stored information or evidence that refer to, evidence or
reflect each and every discussion within the City of Oakland (including the Public
Works Dept. and Police Dept.) regarding any report of concern or complaint made by
citizens, sidewalk users, drivers, City officials, law enforcement, or any other person
regarding the subject location.

 

4. All documents, electronically stored information or evidence reflecting any and all
records related to the cause for repair or alteration of the subject location from
January 2008 to the present.

 

5. All documents, electronically stored information or evidence reflecting any and all
records related to any service requests made to you4 or by you of the subject location
from January 2008 to the present.

 

6. All documents, electronically stored information or evidence reflecting any and all
records related to any communications you had with any other person regarding the
repair or alteration of the subject location from January 2008 to the present.

 

7. All documents, electronically stored information or evidence reflecting any and all
records related to your knowledge of any precautions taken to warn
pedestrians/drivers of the dangerous condition at the subject location from January
2008 to December 1, 2018.

 

8. All documents, electronically stored information or evidence reflecting any and all
records reflecting when you became aware that an incident5 had occurred at the
subject location.

 

9. All documents, electronically stored information or evidence reflecting any and all
design plans for the subject location from January 2008 to the present.

 

10. All documents, electronically stored information or evidence reflecting any and all
911 emergency calls relating to the incident wherein Amro Al Naulsi was injured at
the subject location on October 23, 2018.

 

11. All documents, electronically stored information or evidence reflecting any and all
911 emergency calls relating to any accidents or injuries sustained by a person at the
subject location from January 2008 to the present.

 

12. All photographs, video tapes motion pictures or slides (in their native format, e.g.
actual digital files) regarding the October 23, 2018 incident in which Amro Al
Nabulsi was injured.

 

13. All photographs, video tapes motion pictures or slides (in their native format, e.g.
actual digital files) regarding any and all accidents which occurred at the subject
location from January 2008 to the present.

 

14. All documents, electronically stored information or evidence reflecting any and all
incidents wherein a person was injured at the subject location from January 2008 to
the present.

 

15. All documents, electronically stored information or evidence including, but not
limited to, reports, notes, memos, e-mails, minutes, or videotapes that refer to, any
discussion at Any City of Oakland meetings between 2008 to the present regarding
the subject location.

 

16. All documents, electronically stored information or evidence that refer to, evidence or reflect any postings on Facebook or any social media regarding the subject location
from January 2008 to the present.

 

17. All documents, electronically stored information or evidence that refer to any and all
recommendations, of any kind. to you or by you regarding the subject location from
January 2008 to the present.

 

18. All documents, electronically stored information or evidence that refer to any and all
studies, research, or reports made for the subject location from January 2008 to the
present.

 

19. All documents, electronically stored information or evidence that refer to any and all
design plans, as-built plans, construction plans, signage plans, and/or striping plans
for the subject location.

 

20. All records, reports, or other evidence relating to t your investigation of the incident
of October 23, 2018, wherein Amro Al Nabulsi was injured.

 

21. All documents, electronically stored information or evidence that refer to any and all
photographs, audio and video recordings of the scene of the fall, injuries to Amro Al
Nabulsi, of Amro Al Nabulsi taken at any time before, during, or after October 23,
2018, and of the subject location taken before, during, or after the incident, and any
other photographs, audio and video recordings concerning and/or relating to this
incident.

 

22. All documents, electronically stored information or evidence that refer to any and all
statements the City of Oakland has given reflecting, and/or concerning this incident,
including any recorded, written, transcribed, dictated or videotaped statements.

 

23. All documents, electronically stored information or evidence that refer to any and all
statements given by any and all witnesses reflecting, and/or concerning this incident,
including any recorded, written, transcribed, dictated or videotaped statements.

 

24. All documents, electronically stored information or evidence that refer to any and all
reports for the incident.

 

25. All documents, electronically stored information or evidence that refer to any and all
maintenance requests for the subject location from January 2008 to the present.

 

26. Please provide a complete copy of any and all inspection logs for the subject location from January 1, 2008 to present.

 

27. Please provide a complete copy of any and all written accident prevention policies forthe subject location from January l, 2008 to present.

 

28. Please produce a complete copy of any and all documents reflecting and/or
concerning policies and procedures for inspecting streets/roadways from 2008 to the
present.

 

29. Please produce a complete copy of any and all documents reflecting and/or
concerning policies and procedures for maintaining streets/roadways from 2008 to the
present.

 

Please make sure that the City of Oakland puts a litigation hold on any of the above evidence relating to this location or incident (and that all emails are saved).

 

It is imperative that you take affirmative steps to preserve these items as the failure to do so may constitute negligent or intentional spoliation of evidence in which case we would seek evidentiary, issue and/or terminating sanctions. Kindly advise us where these items are located and to the extent that you are aware, the identity, address, and telephone number of any other party who may have in his possession any evidence relating to the incident.


Please do NOT dispose of any of these documents and items as we will need them. We
would be willing to pick them up and pay for them. Thank you for your prompt attention to this matter.
